Terms & Conditions

Recruiting terms and U.S. regulatory disclosures for CDL driver applicants. Template — have it reviewed by a qualified attorney before relying on it.

1. Acceptance of terms

By using this website or submitting an application, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the site.

2. Nature of our service

DriveNation USA is a CDL driver recruitment service. We are not the employer of record unless stated in writing. Submitting an application does not guarantee employment, an interview, a position, or placement with any motor carrier. Final hiring decisions are made solely by the hiring carrier.

3. Eligibility

Applicants must be at least 21 years old for interstate commerce (49 CFR 391.11), legally authorized to work in the United States, hold a valid Class A CDL where required, and meet the qualification requirements of the hiring carrier and the Federal Motor Carrier Safety Administration (FMCSA).

4. FMCSA & DOT compliance

All positions are subject to FMCSA and U.S. Department of Transportation regulations, including driver qualification files (49 CFR Part 391), hours-of-service rules (Part 395), DOT physical examinations and medical certification, pre-employment and random drug & alcohol testing (Part 382 and Part 40), and a query of the FMCSA Drug & Alcohol Clearinghouse. English language proficiency is required under 49 CFR 391.11(b)(2).

5. Background checks (FCRA)

Carriers may request a consumer report, Motor Vehicle Record (MVR), PSP report, and previous employer safety performance history (49 CFR 391.23). Any such report will only be obtained after you receive a separate, standalone disclosure and give written authorization, as required by the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.). You have the right to receive a copy and to dispute inaccurate information.

6. Pay, miles & bonus disclosures

Pay rates (CPM or percentage of gross), guaranteed miles, home time, pay holds and loyalty bonuses shown on this site are recruiting offers from participating carriers. They are subject to qualification, carrier policies, dispatch rules, freight availability, and the written agreement you sign, which controls in case of conflict. Guaranteed amounts apply only when all program conditions are met (for example, the rate non-negotiation policy for lease/rent drivers). Bonuses are paid only if you remain actively employed or contracted and in good standing on the stated paycheck date. A 2-week pay hold replaces an escrow fee and is released per your agreement.

7. Lease, rent & owner operators

Lease/rent and owner-operator arrangements are independent contractor relationships governed by the federal Truth-in-Leasing regulations (49 CFR Part 376). All compensation, deductions, chargebacks and escrow or hold terms must be stated in a written lease. Promised gross revenue depends on compliance with company and dispatch rules. You are responsible for your own taxes (IRS Form 1099).

8. Equal Employment Opportunity

We and our partner carriers comply with Title VII of the Civil Rights Act, the ADEA, the ADA, and applicable state laws. We do not discriminate on the basis of race, color, religion, sex, sexual orientation, gender identity, national origin, age (40+), disability, genetic information, veteran status, or any other protected status. Applicants needing reasonable accommodation may contact us.

9. Calls & text messages (TCPA)

If you opt in to text messages, you consent to receive recruiting messages, which may be sent using automated technology, at the number you provided. Consent is not a condition of applying. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help.

10. Accuracy of information

You agree that all information you submit is true and complete. Falsification or omission may result in disqualification or termination by the carrier.

11. Acceptable use

You may not submit false information, apply on behalf of someone else, use automated submissions, attempt to access restricted areas, or interfere with the site's operation.

12. Privacy & state privacy rights

Our Privacy Policy explains how we handle your information. Residents of California (CCPA/CPRA) and other states with consumer privacy laws may have rights to know, correct, delete and opt out of the sale or sharing of personal information. We do not sell applicant information.

13. Disclaimers & limitation of liability

The site is provided “as is.” To the fullest extent permitted by law, DriveNation USA is not liable for indirect, incidental or consequential damages, or for the hiring decisions, conduct or policies of any carrier.

14. Governing law & changes

These terms are governed by the laws of the United States and the state in which DriveNation USA is organized, without regard to conflict-of-law rules. We may update these terms; the date below reflects the latest version.
